CONTRACT
The Contract for a short-term holiday rental will be between the Hoste Barn (referred to as “We”) and the person making the booking and all members of the holiday party (referred to as “the Customer, or Your or You”) in the following booking conditions. UK Law will govern the Contract. The contract of hire is not effective until We have processed the deposit. The contract will be subject to these booking conditions and must be complied with. The party leader must be at least 18 years of age at the time of booking and prior to arrival We must be provided with a list containing the names, ages, Postcodes and contact details of all guests.
PAYMENT
You may pay by BACS, or if not possible, we accept cheques (but there will be a observed clearance time before confirmation of booking). For Bookings made less than 3 weeks before the start date of the Rental Period, no cheques will be accepted, as payments must be made in cleared funds, i.e. by BACS. All cheque payments shall be made to Hoste Barn at the address stated.
Bookings are CONFIRMED on receipt the deposit of a THIRD of the booking cost. The deposit must be paid within 3 days of booking being placed. The balance of the rental will be due for payment Fifty six Days prior to the booking. The entire rental fee is payable at the time of booking if the is booking is made 8 weeks or less than the start of the rental period. Hoste Barn reserves the right to cancel your booking at any time if the balance is not received by the due date. Hoste Barn will issue a Booking confirmation to you once you have completed our online booking process and in all cases all money due at the time of Booking have been received in cleared funds. You should check the confirmation form carefully and notify Hoste Barn immediately in case of any discrepancy or mistake.
CANCELLATION
a/ If your booking has to be cancelled because Hoste Barn is put under Government Restrictions and has to close and the period of closure covers Your booking You will be refunded in full.
b/ In the event that Your given address is put into Local/Regional Lockdown, rendering You unable to travel, and the period of restriction covers your booking You will be refunded in full.
c/ If your booking has to be cancelled because Hoste Barn has to close through Force Majeure, meaning any of the following circumstances which may hinder or prevent the performance by us of the Contract, including but not limited to: (i) acts of God, flood, drought, earthquake or other natural disaster; (ii) epidemic or pandemic; (ii) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (iv) nuclear, chemical or biological contamination or sonic boom; (v) any law or any action taken by a government or public authority, including without limitation imposing a restriction, prohibition, or failing to grant a necessary licence or consent; (vi) collapse of buildings, fire, explosion or accident; (vii) non-performance by our suppliers or contractors; and (viii) failure of utility service, and the period of closure covers Your booking You will be refunded in full.
d/ Customer inability (or the inability of any, some or all of Your intended party) or disinclination to travel to and stay at Hoste Barn for any reason.
This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, shielding, a call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays,vehicle breakdown, and delays with public transport. These remain at Your risk and do not give rise to a right to cancel or to receive a refund unless We re-let the property, other than according to the sliding scale below. You are strongly recommended to take out UK travel insurance to cover these eventualities. If you choose not to take out UK travel insurance, then you accept responsibility for any loss that you may incur due to your cancellation.
e/ Cancellations must be notified to Hoste Barn by email and once received in writing we will confirm the cancellation request.
f/ Hoste Barn will apply the scale shown in the table below to bookings to determine the amount of the charge, which shall be a percentage of the total cost of the holiday.

g/ On receipt of the cancellation, the above Charts state the amount that the Customer remains liable for at that point in time. Hoste Barn will then use reasonable endeavours to obtain a replacement booking. In the event that Hoste Barn is successful in obtaining a replacement booking, Hoste Barn will refund to the Customer the total amount paid by the Customer for the booking less the 5% Booking Fee and less the difference in price between the Customers’ booking and the replacement booking if one is made.
For example: A £1000 booking, fully paid, cancelled and relet for £900, means that the original Customer will be refunded as follows, £1000 – 5% booking fee equals £950, – £100 rebooking shortfall, = Refund of £850.
i/ It is the responsibility of the Customer to acquire suitable travel insurance for themselves and their party to cover the booking. Hoste Barn strongly recommends that the Customer acquires suitable insurance to cover circumstances beyond the Customers’ control such as, but not limited to, jury duty, incarceration, change in personal or work circumstances, military service, illness – including Covid and shielding, family emergencies and travel delays.
Covid is also now a known risk and it is possible for you to insure your holiday against it. This can include the customer or any of the party having Covid, the customer or any of the party having to isolate or quarantine, or you wishing to shield any Members of the party.

THIRD PARTY SUPPLIERS
a/ If you want to use the services of a third-party supplier whilst staying at Hoste Barn you must ask and receive written permission to do so. This may be for a chef, beauty treatments, bouncy castle hire, magicians, opera singers, baby-sitters etc.
b/ Hoste Barn would need to see the third-party supplier’s public liability insurance, and any other related/required certification. Hoste Barn will then seek approval from Hoste Barn’s insurers to allow the third-party activity to take place.
c/ If all insurances and certification are satisfactory to Hoste Barn and our insurers, permission to invite these suppliers to Hoste Barn will not be unreasonably withheld.
d/ Hoste Barn does not accept liability for the activities of these third-party suppliers.
PERIOD OF HIRE
You should not arrive before 4pm on the commencement date, and leave by 10am on the day of departure.Failure to do so may result in you being charged a further day’s rental. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period, does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured short hold or assured tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period.
NUMBERS OF PERSONS USING THE PROPERTY
Under no circumstances may more than the maximum number of persons stated on the web site occupy the property. We reserve the right to refuse admittance if this condition is not observed. Any persons other than members of your party must not use the facilities at Hoste Barn.
LIABILITY
Hoste Barn, its employees and representatives shall not be liable to you or your party for loss or damage to property howsoever arising. You must take all necessary steps to safeguard yourselves and your property.
CARE OF THE PROPERTY/DAMAGES & BREAKAGES
You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair, and in a reasonable clean and tidy condition at the end of the rental period. You must not use the properties for any dangerous, offensive, noxious, noisy, illegal or immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties. This includes the Smoking of tobacco in any form or E-cigarettes which is not permitted within or around the property. Strictly no barbeques other than in designated area as barn is thatched. A gas BBQ is provided.
Any damages will have to be paid for in full within seven days of notification. We recommend that you have insurance in place to cover this.
You are legally bound to reimburse us for replacement, repair or extra cleaning costs on demand. You agree to keep Hoste Barn and its contents in the same condition and repair as found on your arrival and shall procure that your guests shall also take such care of Hoste Barn and its contents. You may be required by Hoste Barn to pay a security deposit on arrival and you will be advised of the amount at the time of Booking. The security deposit will be refunded at the end of the Rental Period (less any reasonable costs for breakages, damage etc. if applicable). Any security deposit will be taken by the Owner directly. You shall abide by all instructions with regard to the use of Hoste Barn and its fixtures and fittings as notified to You. You must ensure that Hoste Barn is left in a clean and tidy condition on your departure at the end of the Rental Period (including cleaning up after any animals which you have been permitted to bring). Hoste Barn may charge you for the reasonable costs of any additional cleaning if this is reasonably considered necessary.
WIFI
Wi-Fi is provided for the guest’s reasonable use. The guest agrees to reasonable and lawful usage of this service.
RIGHT OF ENTRY
Hoste Barn shall have the right of entry at all reasonable times, except in an emergency where immediate access may be required, for the purposes of inspection or to carry out any necessary repairs or maintenance.
RIGHT TO REFUSE BOOKINGS AND TO TERMINATE CONTRACT
Hoste barn reserves the right to refuse Bookings from: a) groups of people under the age of 21; and/or b) hen or stag parties.You must inform Hoste Barn at the time of Booking if your party falls in either category. Hoste Barn reserves the right to terminate a Contract without prejudice to any rights and remedies accrued by Hoste Barn or You which shall remain following termination and ask You and your guests to leave the Property immediately if it is deemed necessary by or the Owner as a result of your behaviour or that of any of your guests or any other material breach of these Booking Conditions. In the event that your Contract is terminated Hoste Barn reserves the right not to refund to you any part of the Rental Fees in respect of the shortened Rental Period.
COMPLAINTS
Should there be any cause for complaint during your stay, you should notify Hoste Barn promptly and describe the nature of the complaint. There will be someone on call, whom you can contact in the event that you have a problem with Hoste Barn. We will use our reasonable endeavours to resolve any issues. If you wish to make a complaint after your Rental period has ended please do so to Hoste Barn in writing within a reasonable period but note that compensation cannot be offered where a complaint has not been raised during your stay.

DRONES, NIGHT LANTERNS AND FIREWORKS
The use of drones is not allowed without our express written permission. Fireworks are not allowed anywhere in the grounds as the property is thatched and Night Lanterns are expressly forbidden.
GENERAL NOTES – WEBSITE DETAILS
On occasions there may have been a change of circumstances and the Website cannot always be up to date. Please ensure that you check all of the details with Hoste Barn if essential at the time of Booking. Hoste Barn will endeavour to notify you of any changes or inaccuracies in any information contained on the Website as soon as reasonably practical after we become aware of any such change.
GUEST SAFETY
Hoste Barn takes the safety of guests very seriously. Therefore we ask that guests who stay in the Property take a few moments to think about their safety at Hoste Barn. In particular You should
1)Check the layout of the Property, so that in an emergency You and your party can get out quickly and easily.
2) Check the locations of the fire extinguishers and fire blanket and read the instructions for use.
3) Check the location of the first aid box.
4) Read and take note of specific safety information provided in the Property. If you have any concerns about the safety of the Property, whether it be the garden, equipment or facilities, You should contact Hoste Barn immediately.
5) Due to Hoste Barn being a thatched property you must adhere to the rule of no naked flame within 5 metres of the thatch and no bonfires or fireworks. Please read the fire information in the folder.
6) Hoste Barn has a very sensitive smoke alarm system triggered very easily by smoke particles or dust.
Please bear this in mind if your party includes an elderly/infirm person or very young children that Hoste Barn features uneven floors and no stair gates and if these may be a problem for any member of your party, You should consider this when selecting Hoste Barn before making any Booking; please note our Access Statement is accurate and up to date.
LOCATION
Hoste Barn is in a rural locations can experience some animal noise and occasionally noise from grass cutting or other farm machinery or activities.
Flora and fauna: In rural areas, insects and other creatures are fairly common and not necessarily an indication of poor housekeeping standards. Whilst preventative action is always taken by the Property Owners, these creatures can never be eradicated completely.
BUILDING WORKS
Hoste Barn cannot be held responsible for any buildings or road workings which may be carried out close to Hoste Barn. Where we are aware of any anticipated works, we will endeavour to advise You in advance.
Special Requests: Special requests may be made prior to travel and whilst we will endeavour to meet them, this cannot be guaranteed. Under no circumstances will requests accepted by us form part of our contractual obligations.
WITHDRAWAL OF FACILITIES
We reserve the right to alter or withdraw amenities or facilities or any activities without prior notice; where reasonably necessary due to repairs, maintenance, weather conditions and circumstances beyond our control.
PETS
We only allow up to 2 dogs, no other kinds of pets. Dogs have to be booked in and paid for. (£5 per dog, per night). We may allow more dogs to stay but this must be agreed in writing before arrival. In order to maintain our Five Star Gold Cottages for everyone to enjoy, it is necessary that guests bringing dog(s) agree to these conditions.
Additional Terms and Condition for guests bringing their dog(s).
On arrival, and at all other times, your dog(s) must be kept on the lead in and around the property this means keeping them on the lead when you first set out for your walk.
Once they’re out in the paddock they can be off the lead as much as you like provided they are under your control. They must not chase any livestock or wildlife. You must obey the Countryside Code and keep your dog(s) under close control at all times for their own safety as well as for the benefit of other dog owners and livestock.
There are lots of dog walks from our door and in the surrounding area. Please be aware there may be animals in the fields, and only take dogs into fields with animal whilst on a lead. Please also make sure you close any gates behind you.
Poop patrol! When taking your dog(s) for a walk, please pick up after them including in our paddock. We can provide free poop bags and there is a dedicated poop bin in the bin area. And remember to take bags with you to the beach and on walks. You musts also pick up all poops in the gardens.
When you bring a muddy dog back from a walk, please clean them off using the outside taps and the coloured canine towels provided. On no account use the towels provided for human use.
Your dog(s) must not be left alone with free run of the property. If you have a puppy please take extra care. They will chew the furniture or soft furnishings here in our 5-star barn! Maintaining our grading is key to our business and we can’t always repair things, it has to be replaced, at your expense. We can provide a crate for you, with cage mat. We provide a guide of dog friendly pubs and restaurants and places to visit so that your dog can remain with you.
The dog(s) are not allowed on the tennis court .
Dogs are not allowed in the bedrooms, or on the sofas.
We have 2 cats. If your dog(s) have any problem with cats you must notify us prior to booking.
Please thoroughly clean the cottage, including dog hair from rugs, before you leave; if properties require additional cleaning or dogs have been in the bedrooms, or an uncovered sofa, we will charge a £50 fee to cover the cost.
MISCELLANEOUS
If any provision of the Contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of the Contract, and the validity and enforceability of the other provisions of the Contract shall not be affected. You shall not, without the prior written consent of Hoste Barn, assign or transfer, or deal in any other manner with all or any of your rights or obligations under this Contract. A person who is not a party to this Contract shall not have any rights under or in connection with it. The Contract shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
